Terms and Conditions of Purchase
Purchases made at www.brainbella.com are governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Online consumer purchases are primarily regulated by the Norwegian Contract Act, Consumer Purchases Act, Marketing Act, Right of Withdrawal Act, and E-Commerce Act, all of which grant consumers inalienable rights. These laws are available at www.lovdata.no.
The terms in this agreement are not intended to limit the statutory rights of consumers, but rather to outline the key rights and obligations of both parties in the transaction.
1. Agreement
The agreement consists of these terms and conditions, the information provided in the ordering process, and any special conditions agreed between the parties. In the event of a conflict between the information, any specifically agreed terms shall prevail, provided they are not contrary to mandatory law.
The agreement is supplemented by relevant legal provisions governing the sale of goods between businesses and consumers.

Brain Bella is a product developed and sold by Bybellahealth AS.
The buyer is the consumer placing the order and will hereafter be referred to as the Buyer.
3. One-time Purchase or Subscription
When the Buyer places an order for the first delivery of Brain Bella, including any introductory offers or promotional campaigns, they will automatically receive 1 jar for one-time purchases or 2 jars every second month for subscriptions.
Each jar contains 60 gummies, sufficient for one month’s use.
The Buyer must be at least 18 years old to subscribe to Brain Bella.
As a Brain Bella subscriber, you will receive newsletters by e-mail (§15, third paragraph of the Norwegian Marketing Act). You can unsubscribe from newsletters at any time by contacting customer service or using the unsubscribe link in the email.
4. Price
The stated price for the product and services is the total amount payable by the Buyer. This price includes all taxes, shipping, and additional costs. Any extra charges not disclosed prior to purchase shall not be borne by the Buyer.
5. Billing and Payment
Available payment methods are presented at checkout. An order confirmation and invoice will be sent to the Buyer’s registered e-mail address. Accepted payment methods include Visa, Mastercard, and Vipps.
When paying by Vipps or credit card, the payment will be charged immediately or when the goods are dispatched.
All prices are stated in Norwegian Kroner (NOK) and include VAT, shipping to Norwegian addresses, and any other applicable fees and taxes.
Product prices may vary depending on the sales channel or promotional offers, as specified in your email receipt. Any price changes will follow normal market trends.
6. Shipping and Delivery
Shipping and delivery are included in the price. This will be specified in the email receipt and on the invoice.
Products are shipped via Posten Norway directly to the Buyer’s mailing address. Orders are processed and handed over to Posten within 1–2 business days. Delivery normally takes 3–5 business days, depending on location.
Delivery is considered complete once the Buyer has received the product in their mailbox or collected it from the post office. The risk transfers to the Buyer upon delivery.
Currently, we only ship to addresses within Norway.
If an item is out of stock, this will be clearly communicated by email.
Order changes:
If a Buyer wishes to skip a shipment, change the number of jars, update their address, or bring forward the next delivery, they must notify customer service.
9. Subscription Cancellation
There is no binding period or minimum purchase requirement.
A Buyer may cancel their subscription at any time by contacting customer service by phone or email at post@bybellahealth.no.
The cancellation will take effect from the next scheduled delivery, provided notice is given at least 14 days before the next shipment.
If the subscription is cancelled later than this and after the product has already been dispatched, the Buyer agrees to receive and pay for that delivery.
10. Right of Withdrawal
In accordance with the Norwegian Right of Withdrawal Act, the Buyer has a 14-day unconditional right of return for the first delivery of a subscription.
As subsequent deliveries contain the same product, no return rights apply for deliveries received after the first shipment (§22 of the Right of Withdrawal Act).
For one-time purchases, the right of withdrawal always applies.
To exercise the right of withdrawal, the product must be returned in the same quantity and condition as received. The right of withdrawal does not apply if the seal has been broken, as the goods deteriorate and have a limited shelf life.
If the Buyer wishes to exercise the right of withdrawal or has questions, please contact customer service. Returned items must be sent back within 14 days of notifying us.
The Buyer is responsible for return shipping costs. Prepaid amounts will be refunded within 14 days of receiving the returned goods.
If the invoice accompanying the delivery has already been paid, the right of withdrawal must be exercised within 14 days of receiving the goods.
11. Complaints and Defects
The Buyer is fully protected under applicable Norwegian law.
If a product has defects or faults, the Buyer may demand repair, replacement, a price reduction, or cancellation in accordance with the Norwegian Consumer Purchases Act.
The warranty period is 2 years from receipt of goods.
If the product is intended to last substantially longer, the warranty extends to 5 years.
To claim a defect, the Buyer must contact customer service within a reasonable time, and no later than 2 months after discovering the defect.
If the invoice has already been paid, refunds will be made within 14 days upon approval of the complaint. We will also reimburse any shipping costs incurred for approved claims.

12. Privacy Policy
The Seller is responsible for the processing of personal data.
Unless the Buyer consents otherwise, the Seller may only collect and store the personal data necessary to fulfil the agreement in accordance with the Norwegian Personal Data Act (GDPR).
Personal data will only be shared when necessary to complete the transaction or when required by law.
Bybellahealth AS complies with the General Data Protection Regulation (GDPR) and does not store personal data longer than necessary.
We use an online payment provider, which means your contact and order details may be transferred to them for processing your payment. Any data shared will be handled according to the provider’s privacy policy.
13. Disputes
Complaints must be submitted to the Seller within a reasonable time (see sections 9 and 10).
The parties shall attempt to resolve disputes amicably.
